Divorce and Family Law Proceedings in Turkey
We provide clear, practical and strategic legal support to clients facing divorce or family-law disputes in Turkey. For clients living outside Turkey, we also take account of the practical issues arising where the parties, documents or assets are located in different countries, helping to ensure that the matter is managed effectively from the outset.
Divorce is not limited to ending the marriage. A case may also involve interrelated questions concerning children’s arrangements, maintenance, the division of matrimonial assets, the family home, interim measures and the effect in Turkey of decisions made abroad. We assess the particular circumstances of each matter and explain the available options, risks and next steps in straightforward terms.
We assist with a wide range of Turkish family-law matters, including:
-
Contested and consensual divorce proceedings
-
Drafting and reviewing divorce settlement agreements
-
Child custody, contact arrangements and interim child-related measures
-
Claims concerning child maintenance, spousal maintenance and interim maintenance
-
Division of matrimonial property and disputes concerning assets acquired during the marriage
-
Family-home annotations, occupation issues and protective measures
-
Applications and protective-measure processes where there is domestic abuse or an urgent safeguarding concern
-
Powers of attorney, consular formalities and document coordination for parties living abroad
-
Support in using information and documents held outside Turkey in Turkish proceedings
Cross-Border Family Matters
Family disputes with links to Turkey and the United Kingdom, or another country, can engage more than one legal system and set of procedural rules. The country in which the parties live, the child’s habitual residence, the location of assets and any existing proceedings may all affect the appropriate legal approach.
In such matters, we can advise on the practical steps involved in issuing or conducting proceedings in Turkey, whether a foreign decision requires recognition or enforcement in Turkey, and the steps that can be taken remotely through a power of attorney. Where appropriate, we can assist with coordination with lawyers and other professionals in the relevant jurisdiction.
At the outset, we consider the circumstances of the marriage and separation, information relating to any children and assets, existing court orders, and any immediate need for protection. We then provide a clear framework covering the available route, required documents, likely timescale and priority actions.
At every stage, we consider the issues in dispute and the available routes to resolution. We provide strategic support in negotiations, settlement discussions and litigation, according to the client’s interests and the circumstances of the case. The course and outcome of any proceedings will depend on the facts, evidence and the court’s assessment.
If you require legal assistance with divorce, child arrangements, maintenance or financial issues in Turkey, please contact us to discuss your circumstances. Being based outside Turkey does not prevent a matter from being planned and progressed with the appropriate documentation and representation.
